Oh, Texas! Supreme Court Thinks ‘Marriage Is For Making Babies’ (VIDEO)

Justice John Devine of the Texas Supreme Court is the Texas version of Roy Moore. Roy Moore is the Chief Justice of the Supreme Court of Alabama; he is known for going against the SCOTUS ruling on same-sex marriage.

Texas is serving up their own pile of anti-gay hate this time. He is definitely not a fan of the Obergefell v. Hodges ruling last June. They have to allow same-sex couples to get married, but now they don’t want to give these couples spousal benefits. He thinks that marriage is only for making babies.

He said:

“After all, benefits such as health insurance provide financial security as couples decide whether to have a child. An opposite-sex marriage is the only marital relationship where children are raised by their biological parents. In any other relationship, the child must be removed from at least one natural parent, perhaps two, before being adopted by her new parent(s). This does not diminish any child’s inherent dignity, a fact the City presumably recognizes by extending benefits to their employees’ children regardless of the employees’ marital status. But it does explain why the State might choose to direct resources to opposite-sex couples.”

The ruling gave same-sex couples the same benefits as straight couples.

Devine said:

“Marriage is a fundamental right. Spousal benefits are not. The two issues are distinct, with sharply contrasting standards for review.”

What about couples that adopt? Some couples are not having kids at all. Does this count for blended families? There are many scenarios where heterosexual marriages may not produce children.

Slate’s Joseph Stern said that these judges challenging the law is:

“… An ominous sign that conservative judges are striving to work around Obergefell v. Hodges and affirm the constitutionality of state-sponsored anti-gay discrimination.”

Another day, another embarrassment to the south. The Republicans need to get over the same-sex marriage ruling. It’s been over a year.
