As you can see from the video, Tyrone Carnegay is approached by Officer Trevor King as he starts to exit the store. Carnday later learned that a Walmart manager had accused him of stealing a single tomato. Despite posing no threat to the cop, Officer King begins viciously beating Carnegay with his baton. Carnegay hits the ground and at no point does he attempt to retaliate. Carnegay recalled:

“As he’s grabbing me, he’s beating me at the same time, [saying] ‘Get on the ground.’ Beating me at the same time.”

As a result of the beating by King, Carnegay suffered two broken bones in his leg as well as a ruptured artery from the encounter. Those injuries required him to be hospitalized and have a titanium rod implanted in his leg. He also said he was handcuffed the entire time he was in the hospital because Officer King “said I assaulted him and obstructed him from doing his job.”

Craig Jones, who is representing Carnegay in the lawsuit, remarked:

“The officer went into Robocop mode and beat the crap out of him.”

Carnegay was jailed for three days after being charged with misdemeanor charges of simple battery against police and willful obstruction of law enforcement officers. Those charges were eventually dropped.
