A woman from Carlsbad, California, has filed suit against the police department for a 2013 incident in which officers who pulled her over for a seatbelt violation began punching her in the face as they arrested her.

Cindy Hahn brought a police brutality suit for actions which occurred as her two children, ages 7 and 11, watched the violent takedown of this 40-year-old mother.

According to Hahn’s complaint, on July 31, 2013, she and her children were in the process of leaving a birthday party when they came upon a vehicle which was unoccupied and had its security alarm blaring.

Police cruisers surrounded the unoccupied vehicle, but officers allowed the car alarm to blare. When Hahn dared to ask an officer on duty why police weren’t shutting off the car alarm, the officer — identified in court documents as Officer Kenyatte Valentine — allegedly told her to mind her “own fucking business.”

Ms. Hahn then used her cellphone to call a police non-emergency line and complain about Officer Valentine’s rude behavior. As she began to drive away, Valentine pulled her over and claimed that she wasn’t wearing her seatbelt. He and another officer then proceeded to pull her from the vehicle and pin her to the ground. Hahn recalls:

“I can feel hands on me. It’s the weirdest feeling.”

In the video, Officer Valentine can be seen punching Hahn in the face numerous times.

According to the court filing:

“Ms. Hahn was transported to the emergency room where she was diagnosed with head and brain contusions and subsequently diagnosed with a concussion based on the Defendant Police Officer’s violence. Ms. Hahn suffers permanent memory loss and brain trauma as well as other physical and emotional injuries from the beating.”

For their part, Carlsbad police officials released a written statement in which they say the department looks forward to seeing the case go forward:

“We are prepared to provide a complete and detailed account of the facts of this incident in a courtroom, not in the media.”
