Elkis Hermida Sexually Assaulted A 14- Year- Old Girl. What Happened Next Is Worse.

 


An unnamed 14- year- old girl was raped by her teacher, Elkis Hermida. Hermida was convicted in criminal court and sent to prison in 2011. However, the Los Angeles Unified School District (LAUSD) says the rape is the girl’s?fault.

The minor was befriended by Elkis when she was thirteen years old. Over the course of a year, depending upon your point of view, he either groomed her or she seduced him. To be fair, when the relationship became public, the teacher was arrested and sentenced in 2011 to three years in prison for lewd acts against a child. The parents then filed a civil lawsuit against the school district. That is when?things started going horribly wrong. The first bad break the family got was the case landed in the courtroom of Lawrence Cho,?a Governor Schwarzenegger?appointee who is so bad and so frequently known for being incompetent that he even has his own YouTube mini-infomercial!

According the site where “judges are judged,” ?The Robing Room, his (dis)Honor Cho has a rating of three. Which is low by any standard and the reviews written of him on the site are mostly like the following: “He is completely unable to function in a manner that is consistent with the law. He continuously applies both the law and courtroom procedural rules in an unfair and unbalanced manner. He appears to generally always go against the defendant. I’m not sure who wrote about enjoying the experience, but they must mean to enjoy the Star Chamber proceedings, in which he so grossly violates standards of ‘due process.'”-The Robing Room review So this was the first strike against the family. They got a judge famous for always siding with whoever has the most power or money in every case. Then came the second strike: the attorney hired by LAUSD, W. Keith Wyatt, came up with what has to be the most vile and wrong argument for justifying an adult having sex with a minor ever put forth and accepted by a court in this country. Also, feel free to click on Mr. Wyatt’s name and take a good look at someone who thinks it is perfectly okay for a grown person to have sex with a fourteen year old. If you know this person think about that before you let your children be alone with him. Some of Mr. Wyatt’s brilliance: “That it is a more dangerous decision to cross a street with oncoming traffic than to have sex with a teacher.” ?Source KPCC ? “That the underage girl knew it was wrong to have sex with her teacher and the district had no knowledge of what occurred and was therefore not liable.”?Source TIME. ? “She lied to her mother so she could have an opportunity to have sex with her teacher, then?she went to a motel in which she engaged in voluntary consensual sex with her teacher. Why shouldn’t she be responsible for that?”?Source CBS Los Angeles. So, apparently, the LAUSD hired an attorney who thinks that any child who can cross the street by themselves is capable of deciding if they want to have sex with an adult. That argument and point of view was not only agreed upon but accepted by a person who has to be the stupidest jurist to ever sit on the bench in California history, Judge Lawrence Cho who can be reached via the Santa Monica Courthouse:

Yesterday, the LAUSD dropped the attorney, AFTER he won the case, and LAUSD has not commented on whether or not they knew the defense Mr. Wyatt was going to mount. It is telling that they fired him for “insensitive comments” made on KPCC (a public radio station) rather than his position that child rape should be legal. The “drop” is also pure smokescreen because, surprise, surprise:

L.A. Unified spokesman Sean Rossall said the district will continue to work with Wyatt’s firm, which is representing LAUSD in 18 lawsuits.”

So even though Mr. Wyatt personally won’t be appearing in court for LAUSD he and the firm he is a senior partner at will still be banking thousands of billable hours on the public dime.

Feel free to contact LAUSD and let them know your feelings about sanctioning child rape but being against “insensitive comments.”
