The California Division of Occupational Safety and Health (Cal/OSHA) has drafted proposed guidelines for adult films that mirror the video made against the passing of Los Angeles’ ballot initiative requiring condoms in adult films. Perhaps Cal/OSHA didn’t realize the video starring James Deen and Jessica Drake was supposed to be a joke?

 

?Ejaculation onto surfaces other than another person’s genitals, eyes, mouth or other mucous membranes or non-intact skin.

The employer shall determine and implement appropriate written methods and schedules for cleaning and decontamination of the worksite.

The employer shall maintain the records required by subsection (g)(1) for at least the duration of employment plus 30 years in accordance with Section 3204, Access to Employee Exposure and Medical Records.

Twenty-one pages of regulations and requirements that will lower the quality of films produced, send California based companies to other states, perhaps even other countries. The companies rich enough to comply with the law will, no doubt, figure out the long term cost of this proposal and leave the state completely. Those companies not rich enough to comply will either break the law or stop producing films in California where there is already a good testing system in place for the industry.

This is “big government” at its worst. It is odd that OSHA wants porn companies to be responsible for injuries the independent contractors they hire may incur but other industries that cause as much or more harm are left alone.

There are real issues in the world that government needs to address. Porn isn’t one of them.
